The West Virginia Intermediate Court of Appeals on Tuesday heard oral arguments in two cases that could determine whether COVID-19 is a compensable disease.
In one case, PrimeCare Medical of West Virginia is asking the appeals court to set aside a Workers’ Compensation Board of Review decision awarding benefits to a nurse who contracted COVID-19. The company, which staffed medical personnel in jails throughout the state, argued that no evidence established a direct causal connection between Brittany Foster’s work and her condition.
