Although workers' compensation costs in Texas continue to decline, the number of businesses that opt out of the system has risen in the last few years, according to a report from the Division of Workers' Compensation.
Texas is the only state with a voluntary workers' compensation system, and the percentage of nonsubscriber companies climbed, from 22% in 2016 to 28% in 2018, the DWC's Biennial Report to the Legislature notes.
