The Texas Supreme Court is set to hear oral argument next month in a dispute over whether a worker, who was killed in a car wreck while traveling with two subordinates to a job site over 450 miles from his home, was in the course and scope of his employment at the time of his death.
Last January, the 4th District Court of Appeals found Candelario Lopez's death compensable. The fact that his employer had provided the vehicle he was driving and also paid for his food and lodging near the job site established that his fatal accident was compensable as a matter of law, the court said.
