The South Dakota Supreme Court on Wednesday unanimously overturned a trial judge’s grant of summary judgment awarding a worker payment of her medical expenses for two compensable injuries.
Since Menard Inc. had paid the accumulated medical bills for Cassandra Skjonsberg before the judge issued his ruling, the court said the case should have been dismissed as moot.
Skjonsberg broke her right foot while working at a Menard’s store on Black Friday in 2011.
