A Texas appellate court on Thursday ruled that a charter school was protected by sovereign immunity from a lawsuit filed by a former teacher who alleges she was fired because she filed a workers' compensation claim.
The 1st District Court of Appeals said that open-enrollment charter schools, such as the Promise Community School, have the same immunity as a public school district. And since governmental immunity is not waived for retaliatory discharge claims under Labor Code Section 451, the court said, Doreatha Walker's claim against PCS failed as a matter of law.
