Family Can't Seek Civil Remedy for Worker's Death

A California appellate court upheld the dismissal of a family’s civil claim against an employer over a worker who died after he was struck by a car during a break. Timoteo Alejandro Martinez Ildefonso worked at a Whole Foods store in Venice. During a 15-minute break from his shift, Ildefonso left the store and was struck by a vehicle while using a nearby crosswalk. The driver stopped and spoke to Ildefonso, then drove away.
