3rd DCA to Review PTD Award to Worker Confined to Home

The California 3rd District Court of Appeal has granted review of a case in which it will decide whether an applicant is entitled to an award of permanent total disability benefits because she was medically restricted from working outside her home. The court issued notice that it would review Hallmark Marketing Corp. v. WCAB (Gannon), No. C077512, just before Christmas. Carol Gannon had worked for the Hallmark Marketing Corp. until she suffered an on-the-job injury that left her with rectal incontinence and sexual dysfunction.
