Longtime Factory Worker Fails to Provide Timely Notice of Hearing Loss Claim

The Supreme Court of Tennessee’s Special Workers' Compensation Appeals Panel ruled that a longtime factory worker failed to give timely notice of her hearing loss claim. Arlene Ernstes worked for Printpack Inc. for 43 years. She spent the majority of her time on the plant floor, where she was exposed to loud machinery. Printpack provided annual hearing screens, but Ernstes testified that she did not take the results seriously. She also said Printpack never discussed the results of the hearing screens with her and never suggested she had any hearing loss before she retired in 2016. ...
