A New York appellate court ruled Thursday that the state Workers' Compensation Board can proceed with its claims for indemnification against the former trustees of the now-defunct Retail & Wholesale Industry Workers' Compensation Trust.
The trust went belly-up in 2008, leaving behind some $4.4 million in liabilities.
The board had filed suit against its former trustees in 2011, asserting that their misconduct and malfeasance had caused RITNY to become insolvent, which forced the state to take over management.
