A California appellate court ruled that the doctrine of issue preclusion barred an allegedly injured bus driver from pursuing his fraud claim against his former employer.
Fergus Lewis began working for the Los Angeles County Metropolitan Transit Authority as a bus driver in 1990.
On March 12, 2014, Lewis was directed to drive a bus that did not contain an equipment bag. Lewis refused and told a supervisor an order to do so was illegal. An argument ensued, and Lewis was placed on administrative leave. The MTA terminated him in May 2014.
