The Virginia Supreme Court last week ruled that an employer has a duty to protect its employees' family members from potential exposure to asbestos fibers that the employee may carry home on his work clothes. Courts in different states have split on the issue of “take-home” liability. Virginia joins courts in California, Washington, Louisiana and Delaware in recognizing a duty on the part of employers, but courts in Pennsylvania, Illinois, Maryland, Michigan and New York have rejected it.
