The U.S. 2nd Circuit Court of Appeals on Monday upheld a worker’s conviction and sentence for faking his blindness after suffering an eye injury.
John W. Caltabiano Jr. had worked for a cement company, and dust got into his left eye while he was at work in January 2006.
He received medical treatment for the irritation of his left eye, but he refused treatment for his right eye. Caltabiano was back to work the next day.
