Two Pennsylvania claimants’ attorneys, including the one who represented Mary Ann Protz in a case that led to the elimination of impairment rating evaluations, said Wednesday that a proposed bill aimed at reinstating IREs is unconstitutional because it contains a retroactive provision.
House Bill 1840, sponsored by Rep. Rob Kauffman, R-Franklin and chairman of the Labor & Industry Committee, was introduced Oct. 2 and is before Kauffman’s committee, which could consider the bill as early as noon Monday during its next meeting.
