A claimant's attorney did not win a race to the courthouse against the employer's counsel because a time stamp indicated his complaint was filed two minutes before a benefit review conference concluded with an impasse, the Tennessee Supreme Court ruled Tuesday.The high court conceded that the time discrepancy may have been caused by clocks in two different courthouses that were not synchronized, but ruled that court records cannot be impeached by extrinsic evidence "absent fraud, inevitable accident or surprise."The case is Word v.
