Judge Can Not Reassert Control After Recusal; FL 1st

The First District Court of Appeals for Florida ruled that once a judge of compensation claims (JCC) recuses him or her self from a case, such recusal cannot be reversed by the JCC.In Miller V. Bell South Phone Co. (Fla. 1 DCA CASE NO.: 1D02-4074, 12/08/03) JCC Shelley M. Punancy had recused herself. Later, she reversed that order and reasserted control over the case, then entered an order denying compensability of the claim.
