Workers' compensation carriers doing business in Virginia are required to issue non-renewal notifications even when it's the employer who drops the carrier, a court of appeals decided Wednesday.
Travelers Property Casualty Co. was ordered to pay two claims that occurred after a policy had lapsed for nonpayment of premium. However, the carrier failed to notify the employer or the Workers' Compensation Commission that the policy had lapsed.
Travelers argued that it wasn't required to file an official notice (Form 45A) because the employer -- by its actions -- didn't renew.
