Jurisdiction, Exclusivity Issue Sent to Supreme Court

An employee injured in a traffic collision with a van owned by his employer was not at work at the time of his accident, and therefore his tort claim is not barred by workers' compensation exclusivity, the Missouri Court of Appeals Eastern District ruled.
