Court Hints at Public Policy Concern Over Worker Misclassification

The Minnesota Court of Appeals appears to have latched on to a growing concern among state lawmakers regarding unscrupulous employers who deliberately misclassify workers, ruling that a painter who quit her job to become an "independent contractor" was entitled to unemployment benefits.  Heather Rowan had "good cause" to quit, the court said, since her employer had encouraged her to resign and incorporate as a limited liability company, but then continue performing the exact same work for it, without the benefits and protections she had been afforded as an employee.The case was in Rowan v...
