Unlike its counterpart in Louisiana, the Kentucky Supreme Court has ruled that injured workers may choose their own pharmacy.
The high court's decision, which came down last Thursday, is a victory for defendant Injured Workers Pharmacy, a mail-order business based in Massachusetts. IWP sells medications on a lien basis, taking its orders from treating physicians instead of adjusters, and billing insurance companies for payment.
