On April 13, 2002, Kentucky Governor Paul Patton signed the Kentucky Black Lung legislation (HB 348). This new legislation expands the rights of miners claiming black lung disease.
This legislation replaces HB 1, which was enacted in December 1996.
The new law will allow for the re-evaluation of claims filed after the 1996 law under the provisions of HB 348. In addition, the coal industry will face payment of greater future benefits, says NCCI, due to X-ray specialists being allowed to review the miner's test.
