KS Gov Signs Bill Easing Burden of ETOH Defense

Kansas Gov. Kathleen Sebelius signed a bill Monday that makes it easier for employers to invoke the drug/alcohol defense where injuries are the product of drug or alcohol-related accidents.HB 2141 amends KSA 44-501 to provide that employers meet their burden of proof regarding the intoxication defense by proving that drug/alcohol tests performed after an accident were performed under certain circumstances, such as part of a medical examination.The measure was sought by business groups and clarifies rules that apply when an employer suspects drug or alcohol use contributed to a worker's on-the-...
