The Florida 1st District Court of Appeal ruled Friday that a Judge of Compensation Claims committed reversible error when she failed to determine whether a new repetitive injury provided the major need for medical treatment for a supermarket worker with an existing carpal tunnel condition.
In Cynthia Tice v. Albertson's and Specialty Risk Services, No. 05-0412, the court said the Albertson's meat department worker was denied medical compensation because she failed to prove that she suffered a compensable re-injury through the repetitive use of a meal slicer.
