The Supreme Court of Kentucky held that an administrative law judge (ALJ) has the authority to infer causation from the evidence presented and is not limited to considering testimony from treating physicians.
In Dravo Lime Co. v. Eakins, No. 2003-SC-1027-WC, 02/17/2005, Eakins was employed by Dravo Lime Co. (Dravo) for 33 years and held various positions. As a result of his employment, Eakins was exposed to limestone dust and dust from processed lime.
