Forty-five days may be a standard time frame in many legal proceedings in Texas and around the country. But for injured workers who don’t yet have a lawyer but want to take their claim to court, a month and a half is simply not enough time, the Texas Office of Injured Employee Counsel says in a new report.
OIEC’s Biennial Report to the Legislature and the governor, posted on Dec. 31, recommends extending the deadline, to 90 days, to give claimants more time to gather medical reports, find a lawyer and file the necessary paperwork.
