4th DCA Revives Tort Suit over Coworker Negligence

The Florida 4th District Court of Appeal on Wednesday ruled that a long-time Publix supermarket employee who fatally crushed a coworker while backing up a semitrailer truck may be held liable to his coworker's widow in tort.In a unanimous panel decision by Judge Martha Warner, the 4th DCA said the existence of triable questions as to whether Edgar Javier Ramos was grossly negligent in causing the death of his long-time friend and colleague meant that Ramos was not entitled to the protection of workers' compensation immunity as a matter of law. The case was Boston v.
