Court Upholds Finding That Worker Had 'Aggravation' of Prior Injury, Not 'Recurrence'

The Alabama Court of Civil Appeals upheld a determination that a delivery truck driver suffered an aggravation, not a recurrence, of a prior back injury. Luther Billups worked for United-Johnson Brothers of Alabama LLC as a delivery truck driver. He injured his back at work in October 2016. Billups received treatment and returned to work with light-duty restrictions, but he continued to complain of pain and underwent back surgery in March 2017. Dr. Martin Jones performed an L4-L5 microdiscectomy. Billups did not return to work until he reached maximum medical improvement...
