The Missouri Supreme Court upheld a denial of benefits from the Second Injury Fund for a worker who presented equivocal, but uncontroverted, evidence about whether his preexisting disabilities and work injuries had combined to leave him permanently and totally disabled.
The court said the fact that Robert March presented unimpeached evidence did not render his claim presumptively valid and that he also had to establish that his compensable work injuries combined with his preexisting disabilities rendered him permanently and totally disabled to receive benefits from the fund.
