A New York appellate court ruled that a worker should have been allowed to proceed with his tort claim against a colleague who had struck him with a car as he was crossing a private street on their mutual employer’s property.

Facts: Eric Siegel and Charles Garibaldi both worked for the Culinary Institute of America.
After Siegel completed his work shift and began walking to the campus safety office to clock out, he was struck by a car being driven by Garibaldi.
