The Iowa Court of Appeals overturned the rejection of a worker’s claim against the state Second Injury Fund after she suffered complications from surgery to treat a compensable injury.
Dee Delaney injured her left leg in 1986. She injured her right leg in 2019 while working for Nordstrom.
Delaney underwent knee surgery and returned to work without restrictions. Dr. Nicolas Noiseux assigned Delaney a 37% impairment rating for her right leg.
In June 2020, Delaney began to experience pain and swelling in her right foot. She saw Dr. Dale Beiber, who diagnosed post-surgical lymphedema.
