The Missouri Supreme Court handed down two decisions finding that injured workers were not eligible for benefits from the state’s Second Injury Fund.
In James Eckhardt v. Treasurer of Missouri as the Custodian of the Second Injury Fund, the high court affirmed a Labor and Industrial Relations Commission decision that an injured worker was not entitled to benefits because his doctor improperly relied on a nonqualifying injury when finding permanent total disability.
