An Oklahoma employer on Monday asked the state Supreme Court to weigh in on the amount of credit it could claim against its future liability for a worker’s benefits based on his recovery from a third-party tortfeasor.
Cudd Pressure Control contends that Jason Talbot should have to exhaust his entire net recovery from the third party before its obligation to pay him any further benefits kicks in.
It’s asserting this argument as a cross-claim in the case Talbot commenced last month, disputing Cudd’s entitlement to any credit against his future benefits.
