WCD to Continue Talks on HB 4138 Implementation Sept. 7

The Oregon Workers’ Compensation Division is convening another meeting in September for system users to discuss how to implement House Bill 4138. The bill enacted in March and effective Jan. 1, 2024, limits recovery of overpayments to no more than 50% of the worker’s total award. The bill also requires carriers and self-insured employers to identify overpayments within two years. Another provision requires carriers and self-insured employers to mail or deliver written notice to a worker before ending benefits.
