Father Can't Assert Viable Labor Law Claim for Worker's Fatal Accident

New York’s highest court ruled that the father of a worker who was killed at an industrial plant cannot assert a viable Labor Law claim against the property owner. Case: Preston v. APCH Inc., No. 35 SSM 31, 02/13/2020, published. Facts: Eric Lehman worked as a welder for Alstom Power. He was inspecting the assembly of a 5-ton rotor compartment at an industrial plant in Wellsville in 2008 when the apparatus fell from its stands, pinning Lehman to the floor.
