Applied Underwriters Asks Court to Reject as Unmanageable Class Certification

Attorneys for Applied Underwriters say there are too many differences among allegations of unfair competition relating to its EquityComp and SolutionOne programs that it would make a class action lawsuit “unmanageable.” The Berkshire Hathaway affiliate that administers the loss-sensitive, profit-sharing programs said the plaintiffs have failed to show that their claims are typical of each other, let alone the other California employers in the proposed class they seek to represent.
