Court Upholds Finding That Worker's Condition Worsened, but Not to Point of Total Disability

The Kentucky Court of Appeals upheld a determination that a worker’s impairment had worsened, but he did not establish that he was permanently and totally disabled. Case: Bass v. Zenith Logistics, No. 2022-CA-0297-WC. 08/05/2022, unpublished. Facts and procedural history: In December 2017, Administrative Law Judge Grant Roark issued an opinion finding that Nicholas Bass had proven that he sustained a work-related lumbar injury with a 13% impairment rating subject to a three-times statutory multiplier.
