A New York appellate court upheld a fee award to an injured worker’s attorney.
Miosotis Peralta worked for the Supreme Court 1st Judicial Department as a court officer. She sustained injuries to her left shoulder and left knee in November 2021 while attempting to remove an unruly individual from a courtroom.
Peralta was unable to work after Nov. 5, 2021, and, throughout her ensuing absence, the employer continued to pay her salary under the terms of a collective bargaining agreement.
Peralta filed a workers’ compensation claim in May 2022.
