Injured Worker Can Proceed With Labor Law Claim Against Homeowner

A New York appellate court upheld a grant of partial summary judgment that allowed a worker to proceed with his Labor Law action against one of two homeowners. Case: Liu v. Yung, No. 2022-07197, 03/06/2024, published. Facts: Jia Zhong Liu allegedly suffered injuries in a fall from a ladder while working at a home owned by Jack Chiang Min Yung and Tzufen Chiang Chen. According to Liu, Yung had positioned the unsecured A-frame ladder on an exterior deck and instructed him to climb it to address an apparent leak in a second-floor bathroom.
