Court Upholds Denial of Worker's Request to Expand Scope of Back Injury Claim

West Virginia’s Intermediate Court of Appeals upheld the denial of a worker’s request to expand the scope of his claim for a back injury. Ken Gregory worked for the Raleigh County Board of Education. He allegedly suffered a back injury at work in January 2023. Gregory filed a workers’ compensation claim, supported by a doctor’s report that he had sustained an acute exacerbation of chronic lumbago with right sciatica as a direct result of an occupational injury.
