A trial court did not abuse its discretion by denying a post-dismissal motion for sanctions without first holding a hearing, an Ohio appellate court ruled.
Michael Shields worked as a mechanic for the Greater Cleveland Regional Transit Authority. He received workers’ compensation benefits for a left shoulder injury suffered in 2015. In 2018, he sought additional compensation for a right shoulder injury, saying he was forced to use it more to compensate for his injured left shoulder.
The Ohio Industrial Commission denied additional compensation.
