Safety consultants don’t need to fully assume the employer’s responsibility to provide a safe workplace in order to owe a duty of care to workers, California’s 5th District Court of Appeal ruled.
The appellate court said in a decision released Monday that the Fresno County Superior Court erred in dismissing a wrongful death claim that Oscar and Laura Peredia filed against HR Mobile Services Inc. The Peredias said the company’s negligence caused the death of their son, Oscar Peredia Jr.
