Bankruptcy Judge Says Comp Experience Rating Didn't Transfer With Sale of Debtor's Assets

A federal bankruptcy judge in New Hampshire ruled last week that the National Council on Compensation Insurance could not assign a debtor's workers' compensation experience rating to the purchaser of the debtor's assets. Judge Bruce Harwood reasoned that a debtor's experience rating was an "interest" of which the American Resource Staffing Network's assets were "free and clear" under the terms of the court-approved transfer of ownership to Wicked Staffing Solutions.
