The Delaware Supreme Court revived a subrogation claim by a workers’ compensation carrier against the payments an injured worker received from her employer’s underinsured motorist carrier. Edna Manz worked for Apis Services Inc. She suffered injuries in a motor vehicle accident and filed a workers’ compensation claim. At the time of the accident, Apis used ProAssurance Group as its workers’ compensation carrier.
