Court Revives Part of Worker's Labor Law Claim for Staircase Fall

A New York appellate court revived part of a worker’s Labor Law claim for his alleged injuries in a fall while climbing stairs to access his work area. Case: Tolk v. 11 West 42 Realty Investors LLC, No. 150752/16, 01/11/2022, published. Facts: Jeffrey Tolk suffered injuries while working on a construction project. Tolk and other workers were required to use the loading dock entrance to the building under construction, then check in with security and go down to the basement level.
