Split Supreme Court Upholds Denial of Benefits for Man With Alleged Back Injury

A divided West Virginia Supreme Court ruled that a worker was not entitled to benefits for an alleged back injury due to discrepancies about when the accident had happened. Brent Baker worked as an equipment technician for Excel Site Rentals Inc. He allegedly suffered injuries while lifting a pallet at work. A treatment note from West Virginia University Hospital Emergency Department on Jan. 10, 2018, indicated that Baker injured his back at work three days prior while lifting.
