A circuit court judge in Virginia on Friday said workers’ compensation exclusivity does not preclude a teacher from pursuing a $40 million civil suit for injuries she sustained in a school shooting, according to media reports.
Newport News Circuit Court Judge Matthew Hoffman wrote in his decision, “The danger of being shot by a student is not one that is peculiar or unique to the job of a first grade teacher.”
