Court Overturns Denial of Benefits to Worker Who Failed to Disclose Prior Back Injury

The South Carolina Court of Appeals overturned a denial of benefits to a manufacturing worker for a back injury, finding his failure to disclose a prior injury did not foreclose his claim and that he did not willfully injure himself. Case: Brailey v. Michelin North America Inc., No. 5906, filed 04/27/2022, withdrawn, substituted and refiled 11/02/2022, published. Facts: Issac Brailey began working for Michelin North America Inc. in April 2017. He passed a physical during Michelin's hiring process and was cleared for full duty.
