Supreme Court Will Review Employer's Ability to Subrogate Worker's Recovery Under Dram Shop Act

The Pennsylvania Supreme Court will be weighing in on whether an employer that paid Heart and Lung Act benefits is entitled to subrogation from a claim in which the employee was injured and asserted motor vehicle negligence and Dram Shop Act claims. The issue is being presented in a case called Alpini v. WCAB (Tinicum Township). The case arose out of an April 2011 car accident involving Tinicum Township Police officer Christopher Alpini and motorist Steven Warrington, who was intoxicated when his vehicle struck Alpini’s patrol car.
