Officer's Cancer Case Raises Question about Disproving Presumption

A police officer has asked a California appellate court to decide whether the City of Westminster disproved that his cancer was work-related, giving the court an opportunity to clarify the standard for overcoming the presumptions created by state statutes that cancer and other ailments suffered by police officers and firefighters are compensable.  The 2nd District Court of Appeal is currently mulling whether to grant a petition for a writ of review in the case of Pesko v.
