A Texas appellate court ruled that a worker’s death in a motorcycle accident while retrieving his company-issued laptop from home was not compensable.
Michael Evans was a safety consultant for Xcel Energy. On Aug. 10, 2016, Evans rode his motorcycle to his workplace, used his security badge to enter the building and then realized that he had forgotten his company-issued laptop. He left the building, returned home for the laptop and headed back to work. On the ride back, he was involved in a fatal accident.
