Supreme Court Adopts Limit to Prohibition on Insurer Seeking Subrogation From Insured

In a unanimous decision, the Pennsylvania Supreme Court on Wednesday adopted an exception to the general equitable prohibition of an insurer seeking subrogation from its insured. Robert Arlet had worked for Flagship Niagara League as a shipwright maintaining the Brig Niagara. Acadia Insurance Co. issued a commercial hull policy to Flagship, providing coverage for damages incurred by and damages caused by the Brig Niagara, as well as protection and indemnity coverage for 17 crew members.
